DMCA Policy

Health News Network LLC respects the intellectual property rights of others and expects users of the Zanzi service and website to do the same. This policy describes our notice-and-takedown procedure under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Reporting Alleged Copyright Infringement

If you believe that material available on or through the Service infringes a copyright you own or control, you may submit a written notice of infringement (a "DMCA Notice") to our Designated Agent below. We will process notices that comply with the requirements of the DMCA.

Required Elements of a DMCA Notice

To be effective, your DMCA Notice must include substantially the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
3. Identification of the material that is claimed to be infringing and that you want removed, with information reasonably sufficient to let us locate it (for example, a URL).
4. Your contact information, including your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

Our Response

Upon receipt of a valid DMCA Notice, we will expeditiously remove or disable access to the material that is the subject of the notice and will make a good-faith effort to notify the party who provided or posted the material. We may also, in appropriate circumstances, terminate the accounts of users who are repeat infringers.

Counter-Notification

If you believe your material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Agent. To be effective, your counter-notification must include substantially the following:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the Southern District of New York), and that you will accept service of process from the person who provided the original DMCA Notice or their agent.

If we receive a valid counter-notification, we may reinstate the removed material in 10 to 14 business days after receipt, unless the original complaining party notifies us that it has filed a court action seeking to restrain the allegedly infringing activity.
